Article 1 - Definitions

1.1 - General Conditions: the general conditions detailed below.


1.2 - Order Procedure: the procedure that the Customer follows on our Website to order a product.


1.3 - Customer: the counter-party of DesignJewels.eu with whom DesignJewels goes into an Agreement


 1.4 - Agreement: agreement of which the General Conditions are part of for the sale and delivery of the Product(s) sold by DesignJewels.eu


1.5 - Parties: DesignJewels.eu and Customer are both the parties designated here.


1.6 – DesignJewels.eu: the party which uses the General Conditions, counter party of the Customer. Also known as DesignJewels and represented by Alex Boschmans.


1.7 - Website: the website of Designjewels.eu, represented by the following URL’s :

    • 1.8 - Product: item or service that is offered for Sale by DesignJewels.eu on the Website which the Customer can order via the Order Procedure.

       

      Article 2 - Applicable

      2.1 - The General Conditions are applied to all actions and Agreements between the aforementioned Parties, even when actions of the concerned parties do not lead ultimately to an Agreement.


      2.2 - Application of general conditions and/or specific conditions that are set by the Customer are excluded from the above Agreement and are as such not applicable to the above.

       

      Article 3 - Reaching an Agreement

      3.1 - The Products with their respective prices are offered to the Customer on the website, and an Agreement to sell a particular Product to the Customer can be reached by the Customer completing the Order Procedure for that Product.
      

3.2 – DesignJewels.eu does not guarantee that the offer as mentioned in 3.1 is correct and without faults and/or omissions. Errors in price and descriptions or omissions are possible and can lead to DesignJewels.eu refusing to acknowledge an Agreement that is based on these erroneously  informations. The Agreement is thus not binding. Should DesignJewels.eu decide to refuse the erroneously reached Agreement, they will contact the Customer as soon as possible to inform him/her.


      3.3 - If for any reason whatsoever the Agreement is not binding or cannot be reached, DesignJewels will take care to reimburse, as soon as possible, to the Customer, the amounts already payed, including any initial freight/postal costs, if those costs were asked by DesignJewels.  The reimbursement will happen within maximum 30 ( thirty ) working days after the initial date of the request by the Customer to be reimbursed.

       

      Article 4 - Prices and Payment

      4.1 - Prices as mentioned on the website are inclusive of 21% VAT (Value Added Taxes) if VAT is demanded from the customer. Since July 2013 this company is exempt from asking VAT.

      4.2 - DesignJewels.eu can change the prices for the Products at all times.  This has no consequence for those Agreements that were made before these price changes were made. These Agreements will be processed at the then agreed prices.
      

4.3 - The amounts due by the Customer to DesignJewels must be payed before sending the Product :


      a. by means of a payment service like Paypal or iDeal or other such payment service offered by DesignJewels ;


      b. by bank transfer from a Customers’ bank account to the bank account of DesignJewels;

      Article 5 Delivery

      5.1 - The delivery times as mentioned on the website and in any emails are indicative and are not binding.


      5.2 - DesignJewels.eu will however do all that is possible to deliver the Product in the time proposed.


      5.3 - If DesignJewels.eu cannot sent the ordered Product within 30 (thirty) days then the Customer will be so informed. The Customer then has the right to annul the Agreement and Article 3.3 will apply then.

       

      Article 6 - Return and Refund

      6.1 - The Customer has the right to return the Product within 14 (fourteen) workdays from the date of receiving the Product, without giving any reason, provided the following conditions are met :


      a. the Customer pays for shipping the Product back to DesignJewels - packages sent where the costs are assigned to be payed on receipt by  DesignJewels will not be accepted nor retrieved;


      b. the Customer is responsible for the Product during shipping and handling by the third party - any risk, damage or loss of Product is born and accepted by the Customer until the Product is received by DesignJewels;

      c. the Product returned is undamaged and in pristine state;


      d. the Customer must notify DesignJewels.eu within the first 7 of the above-mentioned 14 workdays that (s)he wishes to do so.


      6.2 - once the Product has been returned and accepted by DesignJewels.eu the Agreement will be considered annulled and the Customer will be refunded - Article 3.3 will apply then.

       

      Article 7 – Complaints

      7.1 - If the Customer finds that properties of the received Product do not correspond to the Agreement then the Customer will contact DesignJewels.eu and the Customer can return the Product provided the following conditions are met : 


      a. the Customer has inspected the Product immediately after receiving it and has notified DesignJewels.eu immediately;
      

b. the Customer has filed a complaint (see the website - Contact Us);
      
c. the Customer pays for shipping the Product back to DesignJewels - packages sent where the costs are assigned to be payed on receipt by DesignJewels will not be accepted nor retrieved;


      d. the Customer is responsible for the Product during shipping and handling by the third party - any risk, damage or loss of Product is born and accepted by the Customer until the Product is received by DesignJewels;


      7.2 - If, after investigation by DesignJewels, the properties of the Product do correspond to the Agreement between DesignJewels.eu and the Customer then DesignJewels.eu will discuss this with the Customer.

      7.3 - If, after investigation by DesignJewels.eu, the properties of the Product don’t correspond to the Agreement between DesignJewels.eu and the Customer, the Customer will have the right to exchange the Product for another, if there are any in stock. The shipping and handling costs will in that case be reimbursed as meant by 7.1 item c. 
If there is no similar replacement Product, the Customer can :


      a. select a replacement Product for the same value as the original Product. If the chosen replacement Product is more expensive than the original Product the Customer must pay the difference. If the chosen replacement Product is less expensive than the original Product the Customer will receive a refund for the difference. The last sentence of Article 3.3 will apply then;
      

b. a refund of the value of the Product is a (part) dissolution of the Agreement where the last sentence of Article 3.3 will apply then.
      

7.4 - Where in 7.3 the value is meant the price as agreed in the Agreement.
      
7.5 - During the period as meant in Article 6.1 the Customer can also return the Product as per Article 6. If however, the customer has made a complaint then the procedure as explained in this Article is assumed to be active.

       

      Article 8 - Your Personal Information as used by us

      8.1 - Personal information collected from the Customer is only used for the following:

      a. to carry out the Agreement between DesignJewels.eu and the Customer;

      b. if the Customer has requested so, to keep the Customer informed about (new) Products and/or Services from DesignJewels.eu

      8.2 - The Customer can at all times request to see the personal information collected and, if incorrect, request DesignJewels.eu to correct the errors.

       

      Article 9 - Law applicable for Complaints

      9.1 - only Belgian Law is applicable on all offers, orders, Agreements, and subsequent actions/agreements resulting from the original Agreement.


      9.2 - If there is a Complaint the Customer will contact DesignJewels.eu - (s)he can use the contact information on the “About / Contact me”  page or the email found on top of the General Conditions page. DesignJewels.eu will respond within 30 (thirty) days to the complaint.

       

      Article 10 - Product description, sizes and colors

      10.1 - Because of the uniqueness of each item, the size and measured lengths of the Products as described in their descriptions on the Website may differ slightly from the actual size. DesignJewels.eu always tries to measure as correct as possible.
      

10.2 - The colors of the actual Product can differ slightly from the Product picture as shown on the Website, for the following (non-exclusive) reasons : the color settings of the computer screen on which the Website is viewed, the uniqueness of each item.


      10.3 - Small differences cannot give cause to Complaints and returns. However, as Customer you can still return the Product during the timeframe as per Article 6 - Return and Refund.

       

      Article 11 - Miscellaneous

      11.1 - The currently valid General Conditions can always be found on the Website. DesignJewels.eu can at all times change the General Conditions. Agreements made before the change of the General Conditions will be honored using the then current General Conditions.


      11.2 - The Customer is wholly responsible for the login details, if any, that he used when entering the Agreement. This information is strictly personal and cannot be transferred to another person. 


      11.3 - DesignJewels.eu is authorized to make use of third parties in the execution of your order(s).
